Organizer of the Self-Paced Learning Programs
Yevhen Domchenko, E-Mail: [email protected], Website: www.growminded.org, offers self-paced online courses, trainings, seminars, workshops, and coaching programs (collectively referred to as “Programs”). Yevhen Domchenko is hereinafter referred to as the “Organizer.”
Scope
All Programs offered by Yevhen Domchenko are conducted solely in accordance with the provisions of these General Terms and Conditions of Registration and Participation.
Program Content and Structure
The self-paced online courses, trainings, and coaching programs offered by the Organizer are designed for both private individuals and professionals. The specific content and structure of each Program are outlined in the respective course description provided on the website.
Where indicated in the course description, participants will receive accompanying digital learning materials, which may include videos, slides, PDFs, exercises, and assessments. These materials are provided via an online platform and are made available at the start of the Program. Pre-delivery or post-delivery of materials outside the platform is not available.
All training content, including materials provided during the Program or created as part of it, is protected by copyright. Participants may not reproduce, distribute, translate, or share these materials, even partially, without the prior written consent of the copyright holder. Reproduction for private, non-commercial use is permitted. Any unauthorized use of the materials is considered a violation of intellectual property law and may lead to legal action.
Recording, copying, or redistributing any part of the Program, whether in audio, video, or written format, is strictly prohibited. This also applies to screenshots, screen recordings, and the sharing of login credentials or platform access with third parties.
Registration, Contract Formation and Payment Terms
Registration for self-paced online Programs is completed via the website’s online booking system. Upon submitting the registration and completing payment, you will receive a confirmation email granting access to the Program. At this point, a binding contract between the participant and the Organizer is concluded.
Invoices are issued electronically and payment is due immediately upon booking. Only upon receipt of full payment is access to the Program granted. If payment is not received, the Organizer is entitled to withhold access without this affecting the participant’s obligation to pay.
Right of Withdrawal
Participants have the right to withdraw from the contract within 24 hours of receiving access to the self-paced online Program, provided that no more than 25% of the course content has been accessed or completed.
To withdraw, a clear written notice must be sent by e-mail to [email protected] within this 24-hour period. If these conditions are met, a full refund will be issued using the same payment method originally used.
Once more than 25% of the course content has been accessed or if the 24-hour period has passed, no withdrawal or refund is possible.
Please note that all Programs are digital products. As such, and in accordance with applicable consumer protection laws, digital content that has been accessed or downloaded cannot be refunded after the withdrawal conditions outlined above expire.
By enrolling in the Program, the participant expressly agrees to these terms and acknowledges that they lose the right to a refund once the course has been substantially accessed or the 24-hour period has lapsed.
Program Access, Changes and Discontinuation
Access to the Program is provided for the duration specified in the course description, generally for a fixed term (e.g., 6 or 12 months). Extensions may be granted under special circumstances at the Organizer’s discretion.
The Organizer reserves the right to update, revise, or replace any part of the Program content as necessary to improve quality or accuracy. Participants will have access to any updated content during their access period at no additional cost.
The Organizer may cancel or discontinue a Program at any time if necessary. In this case, participants will be informed promptly and offered either an equivalent replacement Program or a partial refund based on the unused portion of the Program.
Cancellation and Non-Participation
Once the Program has been accessed, cancellations are no longer possible, and no refunds will be issued. If a participant chooses not to complete the Program or fails to participate, no refunds or credits will be provided unless a withdrawal is declared within the legal period and the conditions outlined above are met.
Rebooking or transferring to another Program is not possible after access has been granted. Exceptions may be made at the Organizer’s sole discretion and must be agreed upon in writing.
Further claims against the Organizer are excluded.
Pricing
All prices quoted include access to the digital course materials and platform. There are no additional charges unless explicitly stated. The Organizer reserves the right to adjust prices. If a price increase occurs and the Program has not yet started, the participant may withdraw from the contract within seven days of receiving notice of the price change. Services already rendered remain chargeable.
Liability
The Organizer is not liable for any damages or expenses incurred by the participant, regardless of the legal basis. Exceptions to this exclusion of liability apply only:
- in the case of liability under applicable product liability law,
- in cases of intent or gross negligence,
- in the event of culpable injury to life, body, or health,
- or for breach of essential contractual obligations (i.e., duties whose fulfillment is essential to the proper execution of the contract and on which the participant regularly relies).
In the case of slight negligence, liability is limited to the foreseeable, contract-typical damage. No liability is assumed for indirect damages, consequential damages, or lost profits.
Data Processing
When registering for a Program, personal data such as name, e-mail address, billing address and telephone number are collected. This data is used exclusively for purposes related to registration, delivery, support, billing, and, where permitted, for marketing of other Programs or services offered by the Organizer.
By accepting these terms, the participant agrees to the use of their data for communication and promotional purposes, including receiving updates about new offers. The data will not be shared with third parties unless required by law, authorized by the participant, or necessary for fulfillment of the contract (e.g., sharing information with certification bodies when a Program includes official certification).
Data will be stored only for as long as legally required or necessary for the performance of the contract.
Final Provisions
These terms and conditions are governed exclusively by the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from this contract is Frankfurt am Main.
Should any provision of these terms be or become invalid, this shall not affect the validity of the remaining provisions.
Oral side agreements are only valid if confirmed in writing.
